Koi Pond Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Koi Pond Discord application (“Koi Pond,” “the bot,” “we,” “us,” or “the service”).

By installing, accessing, or interacting with Koi Pond, you agree to these Terms.

Koi Pond is an independent community project and is not affiliated with, endorsed by, or operated by Discord Inc.

1. About Koi Pond

Koi Pond is a Discord-based virtual pond, collection, progression, and minigame experience.

Users may:

• Interact with shared server ponds
• Feed koi
• Earn virtual Pond Coins
• Collect virtual koi
• Purchase or earn virtual items and upgrades
• Participate in minigames
• Contribute to communal activities
• Activate server-wide boosts
• Participate in leaderboards
• Use other gameplay and customization features

Koi Pond may add, modify, rebalance, replace, or remove features over time.

2. Eligibility

You may use Koi Pond only if you are permitted to use Discord under Discord’s applicable Terms of Service, age requirements, and other policies.

Your use of Koi Pond must also comply with:

• Discord’s Terms of Service
• Discord’s Community Guidelines
• Applicable laws and regulations
• These Terms

If Discord restricts or terminates your access to its services, some or all Koi Pond functionality may also become unavailable.

3. Acceptable Use

You may not intentionally abuse, exploit, disrupt, manipulate, or interfere with Koi Pond or its systems.

Prohibited conduct includes, but is not limited to:

• Intentionally exploiting bugs, glitches, race conditions, or unintended behavior
• Attempting to manipulate Koi Pond’s database or stored data
• Using unauthorized automation, scripts, bots, macros, or similar tools to gain a gameplay advantage
• Attempting to bypass feeding cooldowns, contribution limits, item limits, or other gameplay restrictions
• Artificially manipulating leaderboards, Pond Coins, koi ownership, progression, or rewards
• Attempting to access developer-only, administrative, or restricted features without authorization
• Attempting to impersonate Koi Pond staff or the developer
• Deliberately interfering with Koi Pond’s availability or performance
• Attempting to obtain another user’s gameplay data without authorization
• Using Koi Pond in a manner that violates Discord’s policies or applicable law

If you discover a bug, exploit, or security issue, you are encouraged to report it rather than intentionally abusing it.

4. Virtual Currency, Koi, Items, and Rewards

Koi Pond includes virtual gameplay content such as:

• Pond Coins
• Collectible koi
• Items
• Upgrades
• Boosts
• Minigame rewards
• Limited or event rewards
• Achievements or similar virtual content

Unless explicitly stated otherwise, all virtual content:

• Exists only within Koi Pond
• Has no guaranteed real-world monetary value
• Cannot be redeemed through Koi Pond for cash or real-world property
• Does not represent ownership of a real-world asset
• Does not create a financial account, investment, or stored-value account

Virtual content may be adjusted, rebalanced, renamed, restricted, added, removed, or otherwise changed as Koi Pond develops.

Koi Pond does not guarantee that any virtual item, koi, reward, currency balance, or progression state will remain unchanged permanently.

5. Real-Money Trading and External Sales

Unless expressly authorized by Koi Pond, users may not sell, purchase, auction, trade, or exchange Koi Pond virtual content for:

• Real-world money
• Cryptocurrency
• Gift cards
• External goods or services
• Accounts
• Other forms of real-world compensation

Koi Pond does not recognize or guarantee transactions arranged outside the service.

Users participate in unauthorized external transactions at their own risk.

6. Limited, Event, and Special Content

Koi Pond may offer beta, seasonal, event, commemorative, promotional, or otherwise limited virtual content.

Limited content may:

• Be available only during a specific period
• Require specific eligibility conditions
• Be restricted to certain users or events
• Become permanently unavailable after an event ends
• Return in the future at the developer’s discretion

Ownership of limited content does not guarantee that the content will remain obtainable, transferable, or functionally unchanged.

7. Minigames

Koi Pond may include Discord-based minigames.

Minigame rules, rewards, cooldowns, scoring systems, and availability may change as the service develops.

Users may not use automation, exploits, coordinated manipulation, or unintended behavior to obtain unfair rewards or outcomes.

Koi Pond may correct, remove, or reverse rewards obtained through bugs, exploits, or unintended behavior.

8. Server Administration

Certain Koi Pond features may be controlled by Discord server administrators or members with appropriate Discord permissions.

This may include:

• Pond names
• Pond themes
• Notification settings
• Notification roles
• Notification channels
• Placement of pond panels
• Other server-specific settings

Koi Pond is not responsible for disputes between members of a Discord server regarding how server administrators configure or manage these features.

Server owners and administrators are responsible for managing their own Discord permissions and server settings.

9. Gameplay Adjustments and Corrections

Koi Pond may correct gameplay data when reasonably necessary to address:

• Bugs
• Exploits
• Duplicate rewards
• Corrupted data
• Technical errors
• Unauthorized manipulation
• Incorrect administrative changes
• Other unintended gameplay outcomes

Corrections may include adjusting Pond Coins, feedings, items, koi ownership, leaderboard statistics, progression, or other virtual data.

Reasonable efforts will be made to avoid unnecessary loss of legitimate progress.

10. Service Availability

Koi Pond is provided on an “as is” and “as available” basis.

Reasonable efforts are made to keep Koi Pond operational, but uninterrupted, secure, or error-free availability cannot be guaranteed.

The service may become temporarily or permanently unavailable because of:

• Maintenance
• Updates
• Bugs
• Technical failures
• Discord outages
• Hosting or infrastructure failures
• Security incidents
• Changes to Discord’s APIs or policies
• Other circumstances outside Koi Pond’s reasonable control

Features may be changed, suspended, or discontinued at any time.

11. Gameplay Data and Progress

Koi Pond stores information necessary to provide gameplay and server features.

The collection, use, retention, and deletion of that information is described in the Koi Pond Privacy Policy.

Reasonable efforts are made to preserve gameplay progress, but permanent preservation of:

• Pond Coins
• Koi collections
• Items
• Statistics
• Pond progression
• Leaderboard placement
• Other virtual game data

cannot be guaranteed.

Data may be lost, corrected, reset, or restored from backups in response to bugs, infrastructure failures, security issues, or other technical problems.

12. Suspension or Termination

Access to Koi Pond may be restricted, suspended, or terminated when reasonably necessary to:

• Protect Koi Pond
• Protect users
• Protect Discord infrastructure
• Prevent abuse or exploitation
• Investigate suspected misconduct
• Enforce these Terms
• Comply with legal or platform requirements

Where appropriate, Koi Pond may also remove or correct virtual rewards obtained through prohibited conduct.

No user is guaranteed permanent access to Koi Pond.

13. Disclaimer of Warranties

To the extent permitted by applicable law, Koi Pond is provided without warranties of any kind, whether express or implied.

Koi Pond does not guarantee:

• Continuous availability
• Error-free operation
• Permanent preservation of virtual data
• Continued availability of any particular feature
• Compatibility with future Discord changes
• That bugs or outages will always be corrected immediately

Some jurisdictions may not allow certain warranty disclaimers, in which case those limitations apply only to the extent permitted by law.

14. Limitation of Liability

To the extent permitted by applicable law, Koi Pond and its developer will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the service.

This includes losses relating to:

• Virtual currency
• Virtual koi or items
• Gameplay progress
• Leaderboard placement
• Service interruptions
• Technical errors
• Unauthorized external transactions

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

15. Third-Party Services

Koi Pond operates through Discord and relies on Discord’s platform, APIs, and infrastructure.

Discord is a separate service governed by its own terms and privacy policies.

Koi Pond may also rely on hosting or technical service providers.

Koi Pond is not responsible for the independent operation, availability, policies, or actions of third-party services.

16. Changes to These Terms

These Terms may be updated as Koi Pond develops, its features change, or legal or platform requirements change.

Material changes may be announced through the official Koi Pond community or other appropriate channels.

The Last Updated date at the top of this page identifies the most recent revision.

Continued use of Koi Pond after revised Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
